Man Impersonating Legal Officer in the Office of First Lady Mama Rachael Ruto Released on Bond of Ksh 200K

Waziri Benson Masubo has been released on a bond of Ksh 200, 000 after the Court ruled that the prosecution failed to prove compelling reasons to deny him bond.

According to the prosecution, the accused person on March 21, 2024 by falsely presenting himself as a legal officer in the office of the First Lady Madam Rachel Ruto, assumed to instruct the Nairobi County regional Criminal Investigations Officer Mr. Peter Njeru Nthiga to arrest Patrick Mwangi a former husband to his girlfriend Caroline Ngima.

The accused person was charged with two counts, in count one he was charged with the offence of personating a public officer contrary to Section 105 of the Penal Code.

In count two he was charged with the offence of giving false information to a person employed by public service contrary to Section 129 of the Penal Code.

After taking plea yesterday, the prosecution objected to the release of the accused person on bond stating that there are compelling reasons.

In this regard, the investigating officer, chief inspector John Kiprop filed an affidavit in opposition of bail.

According to the Investigating officer, the accused is a flight risk considering that he had absconded in another case still pending in Milimani Law Courts where he is facing charges of conspiracy to defraud.

In response, the accused said he failed to appear before court because he was under induced coma and obtained leave of the court to be away.

"The court has considered the application by the state to deny the accused bond, it is the duty of the prosecution to prove compelling reasons, my take then is that the prosecution has not provided any compelling reasons to deny the accused person here in bond. I will therefore grand him bond of ksh 200,000 with one surety of similar amount." Ruled Chief Magistrate Bernard Ochoi.
