High Court Rejects MPs' Bid to Make Kenya Kwanza Minority Party in Parliament

 


The High Court has declined an application by Kibwezi West MP Mwengi Mutuse and Machakos Town MP Mutiso Mule to delay the petition seeking orders to overturn the decision by National Assembly Speaker to declare Kenya Kwanza as the majority party in Parliament.


They claimed that Azimio coalition garnered 171 seats in the National Assembly while Kenya Kwanza garnered 164 seats.


Therefore, Wetangula as per Article 108 of the Constitution of Kenya, had no power to declare who are the majority or minority parties in the National Assembly.


According to the petitioners, only Wafula Chebukati, the former IEBC chairman had the power to declare the majority party.
