DP Gachagua Owns Sh1.5bn Disputed City Land Near JKIA, Court Rules

 


The Environment and Lands Court has ruled that Deputy President Rigathi Gachagua is the legal owner of the Sh1.5 billion land situated near JKIA.


The said land has been in dispute since 2022.


The Environment and Lands Court Judge Oguttu Mboya ruled that Wamunyoro Investments is the lawful registered owner of the property in question.


The Judge also ordered the Chief Lands Registrar to rectify the register in the lands office to cancel all unlawful entries on behalf of the company that had laid claims to the property and indicate Wamunyoro as the lawful proprietor of the property.


The registrar was also ordered to cancel and nullify the title issued in favor of the company that had claimed the property.


In 2023, Nairobi Lands Court barred the ministry of lands officer from interfering with a disputed land.


DP Gachagua has been claiming ownership of the land located next to the Jomo Kenyatta International Airport and accused the Ministry of Lands officer of attempting to grab it.


The DP through lawyer Philip Nyachoti has throughout the hearing of the case averred that Mr. Ohas took advantage of his position at the ministry to illegally transfer the land's title to Columbus 2000 Limited which has denied him the right to enjoy the land despite being the registered owner.


"Mr. Ohas took advantage of his position to transfer the title of the land to Columbus 2000 Limited where he is the director and deliberately tampered with the records whereby any official search indicates that Mr. Gachagua is not the owner," said Nyachoti during the case hearing.


  According to the lawyer, the dispute relating to the land's ownership was determined by the National Lands Commission in 2016 when they upheld that the DP and his company Wamunyoro Investments Limited legally acquired the land in 2012 from the original owners.
